Waiver of Lien & Warranty Paperwork
When you submit your invoices to our accounting office, you must include two additional documents. See below.
DOCUMENT 1: Contractor’s Waiver of Lien
A “Contractor’s Waiver of Lien” must be included with EVERY in voice you submit to us. We can no longer process invoices for payment unless they are accompanied by the corresponding Contractor’s Waiver of Lien. There are two different types of this waiver, and I have enclosed blank copies of both of them for your convenience.
Note: A lien waiver is like a receipt for payment you are receiving. For example, if Constructeam pays you $10k, this form would waive $10k in lien rights.
Waiver Type 1: Partial Conditional Waiver of Lien — You should use a partial conditional waiver when you are expecting to receive a progress payment on a project. You may be expecting future payments on the project, but you’ll need to sign a waiver for the specific progress or partial payment that you are receiving. Please make sure the invoice if for the total amount of the project.
Waiver Type 2: Full Conditional Waiver of Lien — A full conditional waiver should be used when you are expecting to receive a final payment on the project. After signing this waiver, you will not be expecting any future payments.
Note: Because these are “conditional” waivers, you may not have received the payment when you submit these forms. That is okay. A conditional lien waiver is “conditional” on your receipt of the payment. It will be invalid if you do not receive payment.
DOCUMENT 2: Contractor’s Warranty
You must now include warranty paperwork with your invoices. I have enclosed a copy of the warranty form that you must submit with the invoice and the Contractor’s Waiver of Lien.
The warranty if for workmanship, so there are certain types of work that will not need to be warrantied. If you are unsure, please contact our office and we’ll let you know.
Examples of Warranty Required Include: Electrical, Plumbing, etc.
Examples of Warranty NOT Required Include: Temporary Labor, Demolition, etc.
